Substantive Labour Code, 1950, Colombia (Night Work Compensation)

Substantive Labour Code 1950; Section 160 & 168 (Night Work Compensation)

In accordance with the Labour Code, night work is the work performed between 22:00 to 06:00 of the following day. Labour Code requires employers to make premium payments to the night workers. A worker employed during night hours, i.e., between 10 pm and 6 am, is paid at a premium rate of 135% of the normal hourly salary paid during weekday except for continuous shift work (36-hours week). In this case, the worker is not entitled to the additional payment for night work. If the night work is performed as overtime, it is paid at the premium rate of 175% of the normal wage rate during the day.

Under the 2017 Labour Code reform, the night surcharge starts from 09 pm instead of 10 pm. The night work is defined as work performed between 21:00 to 06:00 of the following day.
