Substantive Labour Code 1950; Section 10 and 143 (Equal Pay)

The Constitution of Colombia requires the workers be granted equal opportunities for work in all respects. In accordance with the Labour Code, the principle of equal remuneration for work of equal value between men and women workers has to be respected and there cannot be any discrimination on the basis of sex. It also prohibits discrimination in salary on the basis of age, sex, nationality, race, religion, political or union activities. Any difference in pay is considered unjustified until an employer proves objective reasons behind such difference. Such objective reasons may include academic level, experience, productivity, physical work location and seniority of the worker in the enterprise.
