Law No. 9,029/1995

Law No. 9,029/1995 prohibits the adoption of any discriminatory and restrictive practice for access to or maintenance of the employment relationship owing to sex, origin, race, colour, marital status, family situation, disability, professional rehabilitation and age, among other things, and also sets specific provisions for the protection of women’s work. It typifies as crimes the following discriminatory practices:

  • the requirement of a test, examination, investigation, report, certificate, declaration or any other procedure related to genetic sterilisation or the state of pregnancy; and
  • the adoption of any measures, at the initiative of the employer, that constitute induction or instigation of genetic sterilisation, or promotion of birth control (therefore not promoting the provision of services and counselling or family planning, carried out through public or private institutions, subject to the rules of the Public Unified Health System).
